Update – March 2024 – Revised Plans and Additional Information submitted in response to deferral

The City is seeking comment on the revised plans and additional information received for a Development Assessment Panel Application – Form 1 – Five (5) Storey Multiple Dwelling Development located at Lot 201, House Number 39 Chester Avenue, Dianella WA 6059.

The City previously advertised this application, from 15 September through to 16 October 2023, for a Six Storey Multiple Dwelling Development with a communal open space area on the rooftop. The Metro Inner-North Joint Development Assessment Panel (JDAP) considered the application on 13 December 2023 and resolved to defer consideration and request further information from the Applicant. A revised submission has been provided in response to the deferral, for a Five Storey Multiple Dwelling Development. The development is summarised as follows:

  • A Five Storey Multiple Dwelling Development comprising 35 multiple dwellings with seven one-bedroom dwellings, 22 two-bedroom dwellings and six three-bedroom dwellings.
  • A total of 54 car parking bays within the ground and mezzanine levels.
  • A communal open space area located on the rooftop of the development with other landscaped areas provided on the ground level and Level 1.

The application will be determined by the Metro Inner Development Assessment Panel (DAP), which has now superseded the previous Metro-Inner North JDAP. The City’s role is to provide a recommendation to the DAP through a Responsible Authority Report. You are invited to comment on this proposal on or before 5.00pm, Friday, 5 April 2024. Please ensure you quote reference DA23/0883 on any submission. Late submissions will unfortunately not be able to form part of the City’s Responsible Authority Report to the DAP.

Please be advised the City does not provide responses to submissions. The City will notify all submitters in writing of the Metro Inner DAP meeting once the meeting date has been listed by the Development Assessment Panel Secretariat.

The development is zoned Residential R-AC3 and is located within the Dianella Centre Special Control Area. The development application will be assessed against the relevant provisions of the Local Planning Scheme, state planning policies, planning codes and local planning policies, with the primary planning instruments including but not limited to:

  • City of Stirling Local Planning Scheme No. 3 (LPS3);
  • State Planning Policy 7.0 – Design of the Built Environment;
  • State Planning Policy 7.3 – Residential Design Codes Volume 2 – Apartments.

Update – November 2023 – Revised Plans and Additional Information submitted – Six (6) Storey Multiple Dwelling Development

The Applicant has submitted revised plans and additional information for the City’s assessment. The revised submission does not include significant modifications to the proposed development which was advertised for public comment, including building height which remains unchanged. As such, the City will not be undertaking formal consultation of the revised submission.

The revised submission is available for viewing with notification provided to all submitters who made comment on the original proposal which was advertised for public comment. Please note the purpose for making the revised submission available is to inform submitters of the revised submission and provide submitters with the opportunity to prepare questions for Public Question Time for Ordinary Council Meetings and Deputation Requests for the Metro Inner-North Joint Development Assessment Panel (JDAP) meeting. Any submissions provided in response to the revised proposal will not be accepted by the City for inclusion in its Responsible Authority Report.

At present, the City’s Responsible Authority Report is to be submitted to the JDAP by midday, 30 November 2023. Based on this timeframe, the City’s Responsible Authority Report cannot be considered by Council prior to submission to the JDAP. The City’s Responsible Authority Report will be presented to the Ordinary Meeting of Council on 5 December 2023.

Please be advised the City is not the decision maker for this application and the application will instead be determined by the Metro Inner-North Joint Development Assessment Panel (JDAP) due to the value of works. The City’s role is to provide a recommendation to the JDAP through a Responsible Authority Report (RAR). As part of preparing the City’s RAR to the JDAP the City are seeking your comments on the proposal. Your comments will be included within the RAR to ensure that the community’s views have the opportunity to form part of the JDAP’s consideration of the proposal.

You are invited to comment on this proposal on or before 5.00pm, Monday, 16 October 2023. Please ensure you quote reference DA23/0883 on any submission. Late submissions will unfortunately not be able to form part of the City’s Responsible Authority Report to the JDAP.

The application is for a Six Storey Multiple Dwelling Development. The development is summarised as follows:

  • A Six (6) Storey Development comprising 43 multiple dwellings with seven (7) one-bedroom dwellings, 29 two-bedroom dwellings and seven (7) three-bedroom dwellings.
  • A total of 70 car parking bays within the basement and mezzanine levels.
  • A communal open space area located on the rooftop of the development with other landscaped areas provided on the ground level and Level 1.
