The Scheme Amendment proposes including Right of Way 22015 (between Cape Street and Hector Street) into the City's Development Contribution Plan (DCP) for Rights of Way Improvement Works.

A DCP is a mechanism to enable the coordination and delivery of infrastructure (in this instance an upgraded Right of Way), the costs of which are to be shared (in this instance, between landowners adjoining the Right of Way. 

DCP’s typically work by the City funding works up front and recouping the costs when certain types of development occur.  The City introduced the DCP to upgrade certain ROWs in the City in 2015.

The decision to add ROW 22015 to the DCP came about following:

  • Council considered, at its meeting held 2 August 2022, a petition from residents requesting Boom Lane (between Hector and Cape Street) Tuart Hill, be upgraded to a safe and presentable standard.
  • Consideration of a report at the 25 October 2022 meeting of Council, in response to this petition, where Council resolved to consult with property owners abutting the ROW to determine the level of support for various options including full upgrade or closure of the ROW.
  • Consideration of the outcomes of community consultation regarding any potential ROW upgrade at the Council meeting held 7 March 2023.
  • At that meeting, Council resolved to approve an upgrade to the ROW, that it be reclassified to a Category 2 ROW and that it be included in the ROW DCP.
  • Council resolving at its meeting on 22 August 2023 to prepare the documents necessary to bring the DCP into effect. 

If the DCP comes into effect, this will enable Council to add the ROW to its ROW construction programme.

When Council considers the comments received, it must only consider the planning merits of the comments made. The City asks that comments be limited to planning matters or impacts of the proposal.
