Proposed Meeting Procedures Local Law 2021

The City would like your feedback on the reviewed and updated Meeting Procedures Local Law. Closing date: 15 July 2021 Follow project

The proceedings of City of Stirling Council and Committee meetings are governed by the Local Government Act 1995 (the Act), the Local Government (Administration) Regulations 1996 and the City of Stirling Meeting Procedures Local Law 2009.

The Local Law regulates the day-to-day conduct of meetings. The matters that are effected by the Local Law include:

  • Public Question Time
  • Notices of Motion
  • Petitions
  • Deputations
  • Questions on Notice
  • Moving motions
  • Conduct of debate.

Legislation is required to be reviewed from time to time to ensure it reflects current practice and anticipates future needs.

A review of the Meeting Procedures Local Law 2009 has been completed, guided by the following five themes:

  • Allowing minor matters to be ruled by the Presiding Member
  • Allowing for Digital Democracy
  • Aligning Meeting Procedures with current practice
  • Improving grammar and language
  • Simplifying.

What is the draft local law called?

Meeting Procedures Local Law 2021.

When will the local law come into force?

The law is being advertised for public comment and feedback.

Once comments have been received, the City will consider the comments and make a report to Council. If Council adopts the local law, the City will then publish it in the Government Gazette. The local law is then reviewed by the Delegated Legislation Committee.

This process is likely to take approximately 6 months to complete.

What are the main proposed changes to the local law?

  1. Allowing minor matters to be ruled by Presiding Member to improve meeting efficiency (subject to Council resolving otherwise)
  2. Allowing for digital democracy
  3. Aligning Meeting Procedures with current practice
  4. Improving grammar and language
  5. Simplifying.

Why are deputations being increased from 3 minutes to 4 minutes?

To allow for deputations to be more detailed and provides the Presiding Member discretion to efficiently and fairly manage the deputation process between participants.
