Local Planning Scheme No.3: Amendment No. 108 - Proposed changes to the Land Use Permissibility for a 'Market' within various zones

The City’s Local Planning Scheme No.3 defines a ‘Market’ as a “premises used for the display and sale of goods from stalls by independent vendors”. ‘Markets’ can spark urban revitalisation, foster community diversity, and improve public health.

The City recently undertook a review of the City’s Local Planning Scheme No.3 to determine the appropriateness of a ‘Market’ use in the City’s zones. This has led to proposed Scheme Amendment No.108, which seeks to change the land use permissibility of a ‘Market’ within various zones and to be capable of approval in the following zones:

  • ‘Business’
  • ‘Hotel’
  • ‘Industry’
  • ‘Private Institution’.

Draft Local Planning Policy 6.13 - ‘Markets - Exemption from Development Approval’

To support proposed Scheme Amendment No.108, draft Local Planning Policy 6.13 - ‘Markets - Exemption from Development Approval’ has been prepared to exempt markets from requiring development approval where they meet certain requirements.

The draft Policy also seeks to exempt markets on public land from needing development approval.

If adopted, this Policy will further reduce regulation and make it easier and quicker for markets to operate.
