The City is seeking public comment on this Development Application as it proposes the following variations to The Residential Design Codes and Local Planning Policy 2.6 (Building Heights).

Clause 5.1.3 Lot boundary setbacks

North East

  • Unit 1 Upper Floor Balcony to Bedroom 2 wall length setback 2.2m in lieu of 3.8m required
  • Unit 2 Ground Floor Alfresco to Bedroom 3 wall length setback 2m in lieu of 2.2m required
  • Unit 3 Ground Floor Kitchen to Dining Room/Deck wall length setback 1.7m in lieu of 2.3m required.

North West

  • Unit 3 ground floor walk in robe to living wall length setback 1m in lieu of 2.2m required
  • Unit 3 ground floor master to Living wall length setback 1.1m in lieu of 1.5m required
  • Unit 3 ground floor master to deck wall length setback 2m in lieu of 3.4m required
  • Unit 3 ground floor bulk wall length setback 3.2m in lieu of 3.9m required
  • Unit 3 upper floor bathroom to Bedroom 2 wall length setback 1m in lieu of 1.3m required.

Local Planning Policy 2.6 Building height

  • Proposed Unit 2 wall height (pitched roof over) of up to 6.69m in lieu of 6m permitted (measured from the average natural ground level)
  • Proposed Unit 3 wall height (pitched roof over) of up to 7.18m in lieu of 6m permitted (measured from the average natural ground level).

Clause 5.3.7 Site works requirements

  • Proposed fill of up to 1.67m to the North Eastern boundary in lieu of 0.5m fill permitted within 1m of the lot boundary
  • Proposed fill of up to 1.67m to the North Western boundary in lieu of 0.5m fill permitted within 1m of the lot boundary.

Clause 5.3.8 Retaining walls

  • Proposed retaining of up to 1.67m to the North Eastern boundary in lieu of 0.5m retaining permitted within 1m of the lot boundary
  • Proposed retaining of up to 1.67m to the North Western boundary in lieu of 0.5m retaining permitted within 1m of the lot boundary.

Clause 5.4.1 Visual privacy

North East

  • Lot 1 upper floor balcony setback less than 7.5m from the side lot boundary, in lieu of 7.5m required
  • Lot 1 upper floor kitchen major opening setback less than 6m from the side lot boundary, in lieu of 6m required
  • Lot 1 upper floor bedroom 2 major opening setback less than 4.5m from the side lot boundary, in lieu of 4.5m required
  • Lot 3 upper floor living/activities room setback less than 6m from the lot boundary in lieu of 6m required.

North West

  • Lot 3 upper floor living/activities room setback less than 6m from the lot boundary in lieu of 6m required.

South West

  • Raised front outdoor living area setback less than 7.5 from the lot boundary in lieu of 7.5m required.
