Following an approved subdivision proposal for the site, the planning controls for the area required a Local Development Plan to be put in place before development can occur.

The area has been identified in the City’s Local Planning Scheme No. 3 as a ‘Development’ zone since 2010, because of its development potential. Before the area can be developed, a Local Development Plan needs to be put in place following the requirements of the Careniup Swamp 455 North Beach Road Gwelup Structure Plan adopted June 2017 and the Subdivision Approval granted in February 2022.

The purpose of a Local Development Plan is to provide alternative site-specific design control measures to those under the Residential Design Codes (R-Codes). This Local Development Plan seeks to vary the R-Codes provision for: 

  • Street setbacks: street setback of 3m is proposed in lieu of 4m 
  • Setback of carport and garages: garage setback 4m in lieu of 4.5m 
  • Vehicular access: vehicle access from primary street in lieu of secondary street – Lot 15 and 38.

The Local Development Plan is now open for community comment.

A local development plan is a planning tool used to provide alternative site specific design control measures to those under the Residential Design Codes (R-Codes) for matters relating to urban design and the overall look of a built area. At the local government's discretion, a local development plan can also streamline the development approval process, with compliant development exempt from the requirement to obtain development approval.

A local development plan should generally comprise the local development plan provisions and a spatial plan depicting the key elements of the plan over the lots to which it applies (at an appropriate scale).

Local development plan annotations are to relate to elements depicted on the plan and avoid lengthy policy provisions. Diagrams and/or elevations may be included to address multi-level development.

All written submissions received within the public consultation period raising valid planning considerations will be taken into consideration during the assessment of the Local Development Plan.
