Planning schemes and legislation

Local Planning Scheme No.3

Local Planning Scheme No.3 replaces the City of Stirling’s previous District Planning Scheme No. 2. It controls the development and use of land across the City of Stirling (with the exception of portion of land within the Stirling City Centre covered by Town Planning Scheme No. 38). The formal Scheme documents comprise of the Scheme Text and Scheme Maps and must be read in conjunction with the Local Planning Scheme No. 3 - Policy Manual.

The Scheme Text sets out the Local Planning Framework and provides for Local Planning Policies (which define particular requirements and standards for development - refer Policy Manual). Please note that the Policy Manual replaces Development Policies which were adopted under the City’s previous District Planning Scheme No. 2.
 
The Scheme Maps divide the district into zones to identify areas for particular uses and identifies land reserved for public purposes. Most importantly, the Scheme Text identifies the types of uses and development allowed in the different zones. The Scheme Text also sets out the requirements for heritage and special control areas, planning approval, enforcement of the Scheme provisions and non-conforming uses.

Town Planning Scheme No 38

Town Planning Scheme No. 38 covers land located in and around the Innaloo Shopping Centre. The Scheme contains development provisions specific to the sites covered and also contains development contribution provisions for new infrastructure.
